1. Agreement to Terms
By accessing or using the CMA9ja platform, including our website, progressive web app (PWA), and all associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform.
These terms constitute a legally binding agreement between you and CMA9ja. We reserve the right to update these terms at any time. Continued use of the platform after changes take effect constitutes your acceptance of the updated terms.
2. Eligibility
To use CMA9ja, you must:
- Be at least 13 years of age (or the minimum age required in your jurisdiction)
- Be capable of entering into a legally binding agreement
- Not be prohibited from using the platform under any applicable law
If you are between 13 and 18 years of age, you may use CMA9ja only with the consent and supervision of a parent or legal guardian.
3. Account Registration
3.1 Creating an Account
To access most features of CMA9ja, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Keep your account credentials confidential.
- Notify us immediately if you suspect unauthorized access to your account
- Be responsible for all activity that occurs under your account.
3.2 Account Restrictions
You may not:
- Create more than one account per person without our express permission
- Transfer your account to another person
- Use another person's account without their permission
- Register using a false identity or misleading information
4. Platform Use
4.1 Permitted Use
CMA9ja grants you a limited, non-exclusive, non-transferable license to access and use the platform for personal and business purposes, subject to these terms.
4.2 Prohibited Conduct
You agree not to:
- Use the platform for any unlawful purpose
- Post or distribute content that violates our Content Policy
- Attempt to hack, disrupt, or overload the platform or its infrastructure
- Use bots, scripts, or automated tools to artificially inflate engagement metrics
- Scrape, crawl, or extract data from the platform without our written permission
- Impersonate another person, business, or brand
- Use the platform to spam, harass, or harm other users.
- Interfere with the proper functioning of any feature, notification, or transaction
5. Content Ownership and License
5.1 Your Content
You retain ownership of the content you create and post on CMA9ja. By posting content, you grant CMA9ja a non-exclusive, worldwide, royalty-free license to display, distribute, reproduce, and promote your content within the platform, including for marketing and feature promotion purposes.
This license ends when you delete the content or your account, except where your content has been shared by others or is required for legal or operational purposes.
5.2 Our Content
All platform elements created by CMA9ja, including the interface, design, logos, and proprietary features, are owned by CMA9ja and protected by applicable intellectual property laws. You may not reproduce, modify, or distribute our content without written permission.
6. Monetization and Earnings
6.1 Earning on CMA9ja.
CMA9ja provides a CPM-based monetization model that allows creators and content owners to earn from their content performance. Earnings are calculated based on verified engagement metrics as determined by our platform.
6.2 Payout Conditions
To receive payouts, you must:
- Reach the minimum payout threshold as specified in your account dashboard
- Provide accurate and valid payment account details
- Not be in breach of these terms or our content policy
6.3 Earnings Adjustments
CMA9ja reserves the right to withhold, adjust, or reverse earnings that are found to result from fraudulent activity, artificial engagement, or violations of these terms. Disputes regarding earnings must be raised within 30 days of the relevant payout period.
6.4 No Guarantee of Earnings
Participation in the platform's monetization features does not guarantee any specific level of earnings. Earning potential depends on content quality, user engagement, and platform performance.
7. Business and Creator Tools
CMA9ja offers tools for business listings, staff management, service management, and audience engagement. Use of these tools is subject to the following:
- Business information must be accurate and verifiable.
- You may not use business tools to deceive users or misrepresent services.
- CMA9ja is not liable for transactions, appointments, or disputes between businesses and their customers facilitated through the platform.
8. Interactive Features
Features such as Cash Polls, Hot Takes, Debates, Daily Streak Tasks, and Engagement Battles are provided for entertainment and engagement purposes. Participation in prediction-based features does not constitute gambling under Nigerian law as currently understood, but you are responsible for ensuring compliance with the laws of your own jurisdiction.
9. Disclaimers
CMA9ja is provided on an "as is" and "as available" basis. We do not warrant that:
- The platform will be uninterrupted, error-free, or secure at all times.
- Any content on the platform is accurate, complete, or up-to-date
- The platform will meet your specific requirements.
We disclaim all warranties, express or implied, to the fullest extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by applicable law, CMA9ja shall not be liable for:
- Any indirect, incidental, or consequential loss arising from your use of the platform
- Loss of earnings, data, or business opportunities
- Actions or content posted by other users
Our total liability to you for any claim shall not exceed the amount you earned or paid to CMA9ja in the 90 days preceding the event giving rise to the claim.
11. Termination
11.1 By You
You may delete your account at any time through your account settings. Deletion will remove your profile and personal data within 90 days, subject to our data retention obligations.
11.2 By CMA9ja
We reserve the right to suspend or permanently terminate your account at any time if you violate these terms or our Content Policy or if we have reason to believe your activity poses a risk to other users or the platform.
12. Governing Law
These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Nigeria, unless otherwise required by applicable law in your country of residence.
13. Changes to These Terms
We will notify you of material changes to these terms via email or through the platform. It is your responsibility to review updated terms when notified. Continued use of the platform after an update constitutes acceptance.
